The Website provides information about our company and allows you to access and use the Jessica AI Requirements Assistant, as well as any other tools, software, or applications provided by us now or in the future (collectively referred to as ‘Services’).

The Website is operated by WORKSHOPIT PTY LTD (ACN/ABN 20 695 661 557). By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by these terms and conditions (the ‘Terms’).

1.1. Usage: These Terms apply regardless of whether you are a visitor simply browsing the Website or a registered member of the Services. If you do not agree with the Terms, you must cease usage of the Website and the Services immediately.

1.2. Modifications: WORKSHOPIT PTY LTD reserves the right to review and change any of the Terms by updating this page at its sole discretion. Any changes to the Terms take immediate effect from the date of their publication.

3. About the Services

3.1. Scope: WORKSHOPIT PTY LTD provides various AI-powered solutions designed to streamline project management and business operations – the first product of which focuses on gathering requirements for projects. These Terms govern your use of that Service – Jessica AI – and any other current or future Services provided through the Website.

3.2. Licensing: The Services are licensed, not sold. Subject to your compliance with these Terms and payment of applicable fees, WORKSHOPIT PTY LTD grants you a limited, non-exclusive, non-transferable, non-sub-licensable right to access and use the Services during your Subscription Period for your internal business use only.

3.3. Account Tiers: Free Trial, Standard, and Enterprise accounts are currently offered. Features and usage limits may change from time to time. We may offer Pilot programs from time to time, where we grant access at no cost. These are offered for limited time periods and we reserve the right to end these at any time. If you agree to be part of a Pilot program, you also agree to provide a testimonial for display on this website – as part of that same agreement.


4. AI Usage and Fair Use Limits

To ensure fair access, prevent abuse, and maintain high performance for all users, the following usage limits apply to AI generations:

  • Free Trial: Limits are set at the sole discretion of WORKSHOPIT PTY LTD and may be modified or cancelled at any time without notice.

  • Standard Plans: Usage is subject to the monthly generation limits specified at the time of purchase.

  • Enterprise: Usage is governed by separate terms or a Software Licensing Agreement. WORKSHOPIT PTY LTD reserves the right to throttle or suspend access if usage significantly exceeds typical patterns or the specified limits of your plan.


5. Data Privacy and Security

5.1. Personally Identifiable Information (PII): The Services are intended for project requirement gathering. There is generally no requirement for you to input PII into AI prompts. We strongly recommend that you do not enter sensitive personal data belonging to you or third parties as prompt content unless strictly necessary for your specific use case.

5.2. Security Measures: WORKSHOPIT PTY LTD implements industry-standard security measures, including data encryption in transit and at rest.

5.3. Breach Notification: In the event of a confirmed security breach affecting your data, we will notify you within 72 hours of becoming aware of the incident, in accordance with our obligations under the Privacy Act 1988 (Cth).


6. Registration and Subscriptions

6.1. Subscription: To access the Services, you must purchase a subscription (the ‘Subscription’) and pay the applicable fee (the ‘Subscription Fee’).

8. Payments and Refunds

In the event of a dispute, the parties must first attempt to resolve the matter via good-faith negotiations. If unresolved after 28 days, the parties must proceed to mediation in Brisbane, Australia, with costs shared equally.


13. Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland, Australia. You agree that the exclusive venue for resolving any dispute shall be the courts of Queensland.
